Marlin to take legal action

Design looks set to take centre stage in the High Court again, following the launch of another case concerning trademark infringement and passing off.

Marlin Lighting has started proceedings against Gladerealm, of St Albans, accusing it of using stickers bearing the Marlin name and typeface on its own products.

As well as infringing copyright such action, if proved in court, could constitute an attempt to pass Gladerealm’s products off as Marlin’s.

Marlin is now seeking assurances that Gladerealm will not repeat the alleged behaviour, says Marlins’ solicitor David Patterson of Taylor Joynson Garrett.

Staff at Gladerealm were unavailable for comment.
